Ordering from Empire is easy!

Simply give us the basic information (by phone or e-mail) and we'll do the rest.

Your Account Rep will check availability, review your art, and fax or e-mail an acknowledgment with all the details of your order including a total price. Once you arrange for payment, your order will be placed into production.
 
Artwork
At Empire we make ordering of promotional products as easy as possible. After you have chosen the product(s) you want to order, simply e-mail your artwork to us and we'll let you know if we can use it as is or if it requires revisions by our art department.
 
What if I don't have artwork?
We can assist you in creating artwork or making your logo ready for imprinting. Simply fax us a copy of your logo and type style that you prefer and we'll take it from there. Artwork services are billed at $45.00 per hour. If that is necessary, we will let you know before proceeding.

 
I have artwork but I'm not sure if it's usable
The preferred format for your artwork is original vector art saved in EPS format with all designs and fonts turned to outlines. If you don't have this, we can create it for you from the artwork you do have.

How do I send you my artwork?

Special Color Matches - PMS Matches
PMS is an abbreviation for Pantone Matching System™. These are numbered swatches similar to paint chips. Art departments and manufacturers worldwide work from these PMS numbers. Since we are printing on many different types of surfaces and surface colors (black, blue, yellow, orange, etc.) exact PMS matches are not guaranteed. Most of our factories charge for PMS matches. Please inquire for charges on the item(s) you are ordering.

Sample Request Policy
We want you to be pleased with the products you order from Empirepromos and recommend that you order samples of products you are interested in purchasing.

Virtual or Paper Proofs
Our in-house art department will prepare your art for production. Your order acknowledgment will include a virtual or faxed paper proof confirming the imprint that will appear on your order. Once you approve, your order can be placed into production.
 
Product Proofs
Empire can furnish an actual product with your requested imprint, for your approval before production. Product proofs usually cost about $50.00 plus the costs of the item, set up charges, PMS matches and shipping. Additional production time is generally between two to ten working days.

Artwork Charges
Empire will provide up to a half an hour of free art time to prepare your art for production. After the first half hour, there is a $45.00 per hour charge. If that is necessary, we will let you know before proceeding.
 
Imprint Charges
Imprint methods other than the standard process listed for that item may usually incur additional charges. Please call for a quote and/or recommendation of the best process available for your logo on that product.
 
Copy Charges
Imprint changes within a production run are available. Please call for a quote
 
Ink Charges
Imprint color changes within a production run are available. Please call for a quote.
 
Drop Shipments
Empire can ship your order to more than one location. Please call for additional charges.
 
Split Shipments
If you wish to schedule shipment of your order over a specified time period, please call for a quote.
 
Sales Tax
Empire is required to collect sales tax in New York, Texas and sometimes in California. If your company or organization is a nonprofit, we need a copy of your tax exempt certificate. Overseas Resources
 
Over the 20+ years we have been serving the promotional products marketplace, Empire has developed worldwide resources for manufacturing overseas. This enables us to offer reduced pricing and fully customized products. Availability is subject to quantity minimums and extended production time. Dollar amount minimums for overseas orders are usually $2500 and up. Production time varies from 60-120 days. Shipping Methods & Details
 
We make all the arrangements to be sure your products arrive where and when you need them. However, we cannot be responsible for inclement weather, national disasters, customs delays and other unusual circumstances beyond everyone's control.

Empire's products are sold F.O.B. (freight on board) factory. The goods are owned by the purchaser once they are picked up by the carrier. Empire provides a firm ship date for your order and we are happy to recommend the best shipping options and make the arrangements.


Please call us at 877 4PROMOS for special assistance if you need drop shipments (orders being shipped to different locations), split shipments (orders being shipped at different times) or international shipments.


Empire will ship your order using our account and invoice the freight charges including insurance at full value, at published rates. We will also ship using your account number, if you prefer. If you choose to use your own account, you are responsible for the insurance, and the shipment belongs to you once it leaves our factory. Some factories add a shipping and handling charge for each carton shipped under your account number. We will advise you of these charges before final processing of your order. If the shipment is lost or damaged, you are responsible for negotiating with the carrier for reimbursement and your company will still be responsible for the full amount of your our invoice.

 

EmpirePromos can show you how to select the hours of delivery that you would prefer on your UPS shipments. There is no charge for this new service for a three hour preferred window of delivery time.

 
UPS and Federal Express
UPS Ground is usually the most cost effective way to ship promotional items. In cases of high volume orders, trucking alternatives will be given. Within the continental US, shipping time is from one to five days via UPS Ground depending upon where the packages originate and their ultimate destination.

Other options available at additional cost are UPS Sonic Air, Next Day Air, Early AM, Next Day Air, Next Day Air Saver, 2nd Day Air AM, 2nd Day Air, 3 Day Select and Worldwide Express Plus, Federal Express Same Day, First Overnight, Priority Overnight, Standard Overnight, Two Day, Three Day Saver, Ground, and Home Delivery.

Calculating Total Costs
 
Empire will forward you an itemized acknowledgment with all costs of your order before placing it into production. The following additional charges may be involved when producing your custom products and packaging and shipping them to your specifications:
 
Under/Overs
During the imprinting process, products may be discarded that do not meet our factories' high standards. Some factories run extras to be sure to have enough properly imprinted pieces to fill the order. We invoice for the exact quantity shipped. Usually the range is between 5% under and 5% over, but for certain products it can be 10% or higher. Empire will adjust your invoice or credit your account or charge card after your order ships for the exact quantity shipped to you. Please be sure to order a large enough quantity so that if there is an under shipment, you will have enough products for your program.
 
Packaging Requirements
Gift boxes, mailers, gift wrapping and other special packaging options are available. Please call for a quote.
 
PMS Matches
PMS match charges apply each time the order is produced. PMS matching charges generally range from $35.00 to $75.00. Since we are printing on many different types of surfaces (canvas, plastic, rubber, etc.) and on many different surface colors (black, yellow, orange, etc.) exact PMS matches are not guaranteed.
 
Art Charges
If your artwork requires revision to make it suitable for reproduction, artwork charges are billed at $45.00 per hour. If that is necessary, we will let you know before proceeding.
 
Imprint Charges

Major credit cards, money orders, certified checks or wire transfers are acceptable. If you wish to establish credit at Empire, please click here for a credit application. It will take two to three business days for Empire to review the application. Upon satisfactory review, a line of credit will be established.

  We will recommend that you submit a login password in order to simplify future shopping visits, placement of orders and sample requests. Logging in allows us to create "Cookies" which enables us to recognize you as a returning customer.

  As new technologies become available, registering will allow you to access your present and past orders, and products you save for future consideration.
 
E-mail Privacy
We will use your email address solely for the following purposes:
  • Correspondence regarding accurate and timely fulfillment of your order(s)
  • Communicating new promotional ideas, product selections, services and special offers
If you do not wish to receive any information other than that which is pertinent to your order(s) check the box provided on the Sign Up page or in My Account
 
Third Party Providers
Shipping companies, fulfillment houses and our vendors will only be supplied your information on an as needed basis to fulfill your orders. This is generally limited to shipping addresses and recipient phone numbers when required.
 
Credit Cards
We do not maintain a record of the credit card you submit to us for payment once all order charges are complete. Submission of your card number to the appropriate credit card company is via encrypted transmission. Each time you place an order with Empire, we will ask you for your current card information, to protect the security of your card.

Terms and Conditions
 
Acceptance
Your submittal of an on-line or telephone order to Empire Promotional Products and your subsequent signature on our order acknowledgement is a conditional acceptance by Empire Promotional Products of your consent to purchase merchandise from us and confirms your acceptance of our terms and conditions of sale as set forth below. Buyer and Empire Promotional Products agree that any contract hereby entered into shall be interpreted and governed by New York State Law.
 
Use of Trademarks and Designs submitted to Empire Promotional Products
Any company or individual ordering custom-imprinted merchandise Empire Promotional Products, warrants and represents that you are the sole, legal owner or licensee of all rights, including copyright, to each trademark, logo, statement, or any other intellectual property included in the design you instruct us to have imprinted on the merchandise you purchase. Furthermore you warrant that the designs you approve for reproduction are in accordance with the guidelines of the owner of said trademark or logo.

You warrant and represent that no part of the design violates or infringes upon the rights of any person or entity nor is it subject to any restriction or right of any kind or nature whatsoever which would prevent Empire Promotional Products from legally reproducing the images or text submitted.


You agree to defend, at your sole expense, any claim, suit, or proceeding brought against Empire Promotional products for reproduction of the trademarks, logo or written information you supply to us which constitutes wrongful use of any copyright, trademark, or other right of any third party. Empire promotional Products shall not be held liable for the unauthorized, improper, or illegal use of any logo or trademark that is applied to promotional merchandise purchased from us. Further, Empire Promotional products will not accept liability for the actions of clients who have misrepresented their ownership of licenses or trademarks. Further, you agree to indemnify and hold Empire promotional Products harmless from any loss or damage associated with any such claim, suit or proceeding.

 
Reproduction of Trademarks and Logos on Our Web Site
All items shown on our web site containing corporate logos or registered trademarks are shown only to illustrate the logo reproduction capabilities of the companies that produce the respective merchandise displayed on our site. The illustration of any trademark on our site does not constitute any endorsement by Empire Promotional Products on behalf of the owner of said trademark or design.
 
Product Images Displayed on our Web Site
We warrant that we have not altered or enhanced any images shown on our web site to misrepresent the true nature of the product displayed. We strongly urge our customers to request samples of the products they are considering for purchase to ensure that the color and quality meet their requirements for distribution.
 
Product Consistency
We cannot guarantee that all orders purchased through Empire Promotional Products will be 100% consistent in color and material consistency. Minor variations in dye lots, and material thickness and finish are inherent to the manufacturing process. By placing your order with Empire Promotional Products you agree to accept merchandise with such reasonable manufacturing variations.
 
Site Pricing
While we make best efforts to keep our site up to date, from time to time actual market conditions may change the price of a product. We reserve the right to change prices on the site at anytime. If a site price is incorrect on an item that you ordered, we will contact you immediately with the most updated price or help you choose a different item that is within your budget.
 
Transfer of Ownership Merchandise
Empire provides a firm ship date for your order and we recommend the most efficient and cost-effective methods to ship based upon your in hands date and destination. Our products are sold F.O.B. (freight on board) factory and are owned by the purchaser once they are picked up by the carrier.
 
Shipping Delays
Empire Promotional Products shall not be held responsible for delays in delivery resulting from acts of God or other circumstances beyond our control. Our specified ship dates for your order(s) are based on the representations of the factory where your merchandise is produced. We will not be held liable for any special damages or consequential claims that exceed the invoiced value of the merchandise purchased if merchandise is not shipped on the specified date or is delayed in transit.
 
Warranties
We warrant that all merchandise sold to you by Empire Promotional Products is free of any security interest. We shall make available all transferable warranties from the manufacturer of the merchandise available to you, the buyer. We do not express or imply any warranties as to the fitness for purpose of the merchandise you purchase from us.
 
Cancellation or Changes to Existing Orders
Once you have returned a signed order acknowledgment, we cannot guarantee that we will be able to make changes to or cancel your order without incurring charges. This will depend on the extent of work the producing factory has performed on your order. We will advise you in writing of any and all costs incurred prior to making changes or cancellations with the factory. You will be responsible for payment of those charges without dispute. Should you cancel your order with Empire Promotional Products prior to the commencement of production by the factory, you will be charged a processing fee of $50.00 for the work we have done to place your order into production plus proof charges if applicable.

Claims, Adjustments & Returns
Should you have any problems with your order, please contact your Empire Account Rep at (877) 4-PROMOS (877-477-6667) within 15 days of receipt of your merchandise. We urge you to inspect your merchandise upon arrival in order to facilitate the resolution of any claims. Do not return the merchandise to us without receiving a Return Authorization as it will be refused. If you receive a Return Authorization we will advise the correct shipping address for your return. Your Empire Account Rep. will assist you in resolving your claim if your order has not been produced as requested or is defective in manufacture. Claims for merchandise damaged in transit must be resolved with the carrier.
 
Sales Tax

Payment Terms
We may grant Net 30 day payment terms after reviewing your completed credit application. By placing your order with Empire under these terms, you agree to pay our reasonable attorney or collection fees incurred for the collection of any past due balances on your account.
 
Returned Checks
Any checks submitted for payment of our invoice(s) which are returned for insufficient funds will result in a charge of $50.00 to the entity to whom we issued the subject invoice(s).
